The Permanent Labor Certification Process, or PERM, allows a U.S. employer to hire a foreign worker to work permanently in the United States. The PERM process was implemented by the U.S. Department of Labor (DOL) to ensure that the permanent employment of foreign workers in the U.S. will not adversely affect the job opportunities, wages and working conditions of U.S. workers. The PERM certification process varies depending upon the nature of permanent employment. The filing of a PERM application is the responsibility of the employer, not the employee. Once a permanent labor certification application has been approved by the DOL, the employer then obtains immigration authorization from USCIS.
