If you were not able to get an H1B under the FY2012 Cap, begin the process today. In order to increase your chances of obtaining an H1B under the FY2013 Cap, it is best to file your application as soon as possible. The earliest you can file for an H1B is six (6) months prior to the employment start date. Since the H1B FY2013 Cap opens on October 1, 2012, you can file as early as April 1, 2012.
Over the past two years the number of H1B filings has increased and the Cap has filled earlier and earlier. The FY2011 H1B Cap was reached on January 26, 2011 and the FY2012 H1B Cap was reached on November 22, 2011. If current trends continue the H1B Cap could be met as early as September 2012.
