Can I Change my TN Employer? When a TN visa professional is approved for a TN visa, they are only authorized to work for the U.S. employer that petitioned them. If the TN visa professional receives a new offer of employment, they must obtain a new TN visa authorizing employment for the new employer. The TN visa professional cannot start work for the new employer until they have received approval of a new TN visa from U.S. Citizenship and Immigration Services (USCIS), U.S. Customs and Border Protection (CBP), or a U.S. Consulate or Embassy. If you are in the U.S. on a TN visa, you have two (2) options for a change of TN visa employer

  1. Form I-129 Change of Employer with USCIS. If you are currently in the U.S. in valid TN visa status you are able to change or add a new employer by filing Form I-129 with USCIS. The following applies to changing a TN visa employe with USCIS:
    1. You must be in valid TN visa status.
    2. You must show proof that you have maintained your TN visa status.
    3. The position offered must be a qualifying TN visa profession.
    4. You must demonstrate the you possess the necessary qualifications for the TN Visa profession offered.
    5. You CANNOT begin employment for the new employer or travel outside the United States until you have received approval of Form I-129 from USCIS. Form I-129 can take several months to process. If you need approval in an expedited manner you can file to have your case processed in 15 days by using USCIS Form I-907.
    6. USCIS will issue an I-797 approval notice containing your new I-94 card for the new TN visa employer.
  2. In person with CBP. This process is done the same was as obtaining a new TN visa and CBP will apply the same level of scrutiny. Having a TN Visa in the past does not make obtaining a new TN Visa easier. The following applies to changing a TN visa employer with CBP:
    1. You must present a TN visa application with all necessary supporting documents to change your TN visa employer.
    2. The position offered must be a qualifying TN visa profession.
    3. You must demonstrate the you possess the necessary qualifications for the TN Visa profession offered.
    4. Unless you are adding a TN visa employer, CBP will remove the Form I-94 attached to your previous employer.
    5. Upon approval of the new TN visa employer, you will receive a new Form I-94 and TN visa stamp in your passport.
