What changes in employment require a new TN Visa?

When a TN visa is issued it is tied to a specific employer for a specific TN Visa profession. As long as you continue to work for the employer tied to your TN Visa, you continue to work in the designated TN Visa profession with the same duties, and your TN Visa remains valid, it is not necessary to obtain a new TN Visa.

Sometimes, especially in the IT field, employers will assign their employees to a new location, work site, or client site. As long as you continue to work for the employer for which the TN Visa was issued and your duties remain the same, you will not need to obtain a new TN Visa. A new TN Visa would need to be obtained if your employer has changed, there is a substantial change in your duties that places you into a different TN Visa profession or the conditions under which your TN Visa was issued have changed.

Failure to obtain a new TN Visa as the result of substantial changes in your employment situation could result in long term immigration consequences. If there have been substantial changes in your employment situation since you have received TN Visa status, we can help. Contact us so that we can help you determine whether the changes in your employment will necessitate obtaining a new TN Visa.
