When TN-1 Status is issued it is tied to a specific employer for a specific TN profession. As long as you continue to work for the employer tied to your TN status, you continue to work in the designated TN profession with the same duties, and your TN remains valid, it is not necessary to obtain a new TN.
Sometimes, especially in the IT field, employers will assign their employees to a new location, work site, or client site. As long as you continue to work for the employer for which the TN was issued and your duties remain the same, you will not need to obtain a new TN. A new TN would need to be obtained if your employer has changed, there is a substantial change in your duties that places you into a different TN profession or the conditions under which your TN was issued have changed.
Failure to obtain a new TN as the result of substantial changes in your employment situation could result in long term immigration consequences. If there have been substantial changes in your employment situation since you have received TN-1 status, we can help. Contact us so that we can help you determine whether the changes in your employment will necessitate obtaining a new TN.
