U.S. Citizenship and Immigration Services (USCIS) continues to accept H-1B nonimmigrant petitions that are subject to the fiscal year FY2013 Cap. As of May 18, 2012 USCIS has received approximately 42,000 H-1B petitions counting toward the 65,000 Cap, and approximately 16,000 petitions towards the 20,000 Cap exemption for individuals with advanced degrees. This means that there are 23,000 regualr H1Bs and 4,000 for those with advanced degrees still available. Last week saw a sharp increase in H1B petitions over the previous week. If H1B petitions continue to be submitted ate current rates, the Cap will only last for another 4 weeks, or until the end of June 2012. This is good news for employers in need of foreign workers to fill speacialty occuaptions within their organizations. If you are in need of an H-1B visa for an employee in a specialty occupation, act quickly while the Cap is still available.
