U.S. Citizenship and Immigration Services (USCIS) continues to accept H-1B nonimmigrant petitions that are subject to the fiscal year FY2013 Cap. As of May 11, 2012 USCIS has received approximately 36,700 H-1B petitions counting toward the 65,000 Cap, and approximately 14,800 petitions towards the 20,000 Cap exemption for individuals with advanced degrees. This means that there are 28,300 regualr H1Bs and 5,200 for those with advanced degrees still available. Last week saw an increase in H1B petitions over the previous week. If H1B petitions continue a this rate, the Cap could last for another 7 weeks or until the beginning of July 2012. This is good news for employers in need of foreign workers to fill speacialty occuaptions within their organizations. If you are in need of an H-1B visa for an employee in a specialty occupation, the Cap is still available.
