U.S. Citizenship and Immigration Services (USCIS) continues to accept H-1B nonimmigrant petitions that are subject to the fiscal year FY2013 Cap. As of May 4, 2102 USCIS has received approximately 32,500 H-1B petitions counting toward the 65,000 Cap, and approximately 13,700 petitions toward the 20,000 Cap exemption for individuals with advanced degrees. This means that there are 32,500 regualr H1Bs and 6,300 for those with advanced degrees still available. Last week saw a decline af almost 1,000 H1B petitions. If H1B petitions continue a this rate, the Cap could last for another 2.5 months or until the midle of July 2012. This is good news for employers in need of foreign workers to fill speacily occuaptions within their organizations. If you are in need of an H-1B visa for an employee in a specialty occupation, the cap is still available.
