U.S. Citizenship and Immigration Services (USCIS) continues to accept H-1B nonimmigrant petitions that are subject to the fiscal year FY2013 cap. FY2013 began on April 2, 2012 and is expected to last for several months. USCIS provides regular updates on petitions counting against the H-1B cap of 65,000 and the 20,000 U.S. master’s degree or higher cap exemption. As of April 9, 2012 USCIS has received approximately 17,400 H-1B petitions counting toward the 65,000 Cap, and approximately 8,200 petitions toward the 20,000 cap exemption for individuals with advanced degrees. If you are in need of an H-1B visa for an employee in a specialty occupation, the cap is still available.
