In order to qualify for an H1B visa there are many factors that must be proven. Of the many factors involved in the adjudication process, U.S. Citizenship and Immigration Services (USCIS), will look at whether entry into the profession requires the attainment of a bachelor’s degree or the equivalent, whether the specific position requires an employee of such a caliber and whether the employee has obtained the required education and training to fill the position offered. In some cases it is not difficult to provide the proof required to obtain approval. In other cases, significant preperation and effort must be made in order to present a case that USCIS will approve.
We have been able to assist many individuals without academic degrees obtain H1B status in various professions for both small and large companies. One such approval was issued for a small company of four (4) seeking to hire a Director of Sales that had not obtained an academic degree. We worked with both the employer and employee to compile the necessary evidence proving that the company had the need for a Director of Sales, the employee had a combination of training and experience equivalent to a bachelor’s degree and that the position required a person of such education and training. Our efforts were rewarded when the petition for H1B status was approved for the maximum period of three (3) years. With the addition of their new Director of Sales, the employer has been able to expand the distribution of their products into various new locations worldwide.
If you are a foreign national without an academic degree or an employer seeking to employ such a worker, we can help. We are able to assist with the most complex H1B cases and obtain successful results for our clients.
