We were recently approached by an Ophthalmologist working on an H-1B visa that was in need of a limited license to work in New York State. The position that our client was seeking to fill was not in a medically under-served area and his profession was not listed as one with a critical need. We were able to work with the client and the employer to craft an argument that detailed the critical need for his services in the geographic area where he would be employed. Despite the fact that the place of employment was not a medically under-served area, and his profession was not listed as one with a critical need of unmet need, we were able to argue that the services provided by our client were rare and unique enough that he should qualify. Fortunately, the New York Department of Health accepted our argument and granted the limited license to our client. Not only was he granted the limited license, it was done in an expeditious manner.
