TN Visa Change of Employer Options

There are a few options for TN Visa holders to consider when requesting a TN Visa change of employer. (1) File for a TN Visa Change for Employer with USCIS (2) Depart the United States and apply for a TN Visa Change of Employer with CBP when returning to the United States, or (3) TN Visa Change of Employer with the U.S. Embassy or Consulate. We discuss the option for a TN visa change of employer in more detail below:

  1. TN Visa Change of Employer with USCIS – If you want the convenience of a TN Visa change of employer without leaving the United States, you can file Form I-129 with U.S. Citizenship and Immigration Services (USCIS). Things to consider when filing a TN Visa change of employer with USCIS:
    1. You are allowed to remain in the United States while the petition processes as long as you file a timely request for a TN Visa Change of Employer. However, you are NOT allowed to work for the new employer until the TN Visa change of employer request has been approved by USCIS.
    2. Filing fees. When you file for a TN visa change of employer by mail with USCIS you are required to pay filing fees. The standard filing fees start in the hundreds of dollars and can extend into the thousands if you need to expedite your case.
    3. Processing times. The processing times for a TN Visa change of employer with USCIS with standard processing can take several months. This often forces people to pay for 15 day premium processing.
  2.  TN Visa Change of Employer with CBP – You are able to obtain a TN visa change of employer at qualifying U.S. ports of entry and pre-flight inspection. This is done in the very same way as the initial TN visa was obtained. Things to consider when filing a TN Visa change of employer with CBP:
    1. Fast. You are able to obtain the TN visa change of employer the same day you apply with CBP.
    2. Low processing fees. When requesting a TN visa change of employer with CBP you only pay the nominal processing fees.
    3. Canadian citizens are able to request a TN visa change of employer with CBP at any time.
    4. Mexican citizens are also able to request a TN visa change of employer with CBP as long as they have a valid TN visa stamp in their passport.
  3. TN Visa Change of Employer with the U.S. Embassy or Consulate – Mexican citizens are able to request a TN visa change of employer the same way they obtained their initial TN visa with the U.S. Embassy or Consulate.
