Top 5 TN Visa Questions for Employees

Today we’ll be answering the five most common questions that Canadians have about the TN visa process.

Do I qualify for a TN visa?

You may qualify for a TN visa if you can answer, “Yes” to the following questions.

  • You are a Canadian citizen.
  • Your profession is listed on the TN professions list.
  • You have earned the minimum qualifications for the TN profession.
  • And you received an offer of employment or entered into a contract with a US employer.

How do I apply for a TN visa?

Applications for a TN visa can be done by mail with US Citizenship and Immigration Services, or in person at a US port of entry or a preflight inspection point. The application option you choose depends on how soon you need to start working and any complicated factors that may be involved in this situation.

How long is the application process?

With a properly prepared TN visa application, you can apply for and have your TN visa typically within an hour after a brief interview with a border officer. If you choose to file by mail with USCIS, processing can take anywhere from 15 to 60 days.

How long is a TN visa valid for?

A TN visa can be valid from one day and up to three years. The length of state is determined by the length of your employment offer or contract with a US entity. TN visas can also be renewed indefinitely.

Do I need to hire a lawyer to help me with a TN visa?

If any of the following apply to your situation, we recommend using the assistance of an experienced and licensed USA immigration lawyer. If you have previously been refused entry to the United States, you are seeking entry to the United States as a management consultant, scientific technician or will be working in an IT profession, your qualifications are not a clear match to a professional on the TN professions list, or you will be working from Canada while servicing preexisting contracts in the United States.

Also keep in mind that foreign lawyers, notaries, or US immigration consultants are not legally authorized to practice or advise on US immigration.
