Updated FY 2012 H1B Cap Count – Masters Cap is now filled!

The most recent H1B Cap update from U.S. Citizenship and Immigration Services (USCIS) indicates that they have received 20,000 cases towards the H-1B Master’s Exemption. This means that there are no more H-1B Master’s Exemption numbers left for FY 2012. The new report indicates that 49,200 H-1B regular Cap cases have been received, leaving only 15,800 regular Cap numbers for FY2012. Taking into account the 6,800 H-1B visas set aside each year for the U.S. Chile and U.S. Singapore Free Trade Agreements this means there are only 9,000 H-1B Cap numbers left for FY2012. At current H-1B petition rates, this means that the FY2012 H1B Cap could be filled by the end of this month. This places additional urgency on employers seeking foreign specialty workers. Failure to secure a FY2012 H-1B Cap number could mean that the employee will have to wait until October 1, 2012 to begin work.
